TERMS OF SERVICE

“We,” “us,” or “our” refers to Cowboy Coffee Co., a Wyoming company based in Jackson Hole, Wyoming. Contact us at office@cowboycoffee.com or (307) 733-6238.

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from us or create an account. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized use.

We try to display our products, prices, and availability accurately, but errors can occur. Product images are for illustration only. Prices are listed in U.S. dollars and do not include applicable taxes or shipping. We reserve the right to correct pricing errors, change prices, and limit quantities at any time without notice. Products are subject to availability.

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, inventory limitations, or errors in pricing or product information. If we cancel an order after payment has been taken, we will issue a refund.

We accept major credit and debit cards processed through Authorize.Net. By submitting payment details, you represent that you are authorized to use the payment method and authorize us to charge the full amount of your order. You agree to pay all charges, including any applicable taxes and shipping fees.

Our Coffee Club is a recurring subscription. By enrolling, you authorize us to charge your saved payment method on the cadence you select (e.g., every two, four, or six weeks) for the coffee you have configured. Each shipment follows the discount tier and shipping rules in effect at the time of that shipment.

You can pause, modify, or cancel your subscription at any time from your account page, or by emailing us. Cancellation stops future shipments but does not refund orders that have already been placed and shipped.

Shipping, delivery times, returns, and refunds are governed by our Shipping & Returns policy, which is incorporated into these Terms by reference.

The Cowboy Coffee Co.® name and logo, the mark A Taste of the West™, product names, photographs, written content, and site design are the property of Cowboy Coffee Co. or our licensors and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any of this material without our prior written permission, except as expressly allowed by these Terms.

If you submit reviews, comments, photos, or other content to the site, you grant Cowboy Coffee Co. a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing. You represent that any content you submit is your own and does not violate the rights of any third party. We reserve the right to remove any user content at our discretion.

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the Services, servers, or networks connected to the Services.
• Attempt to gain unauthorized access to any portion of the Services.
• Use automated systems (bots, scrapers) to access the Services without our written permission.
• Resell products purchased from us without our written authorization.

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COWBOY COFFEE CO. DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, COWBOY COFFEE CO. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Cowboy Coffee Co., its officers, employees, and agents from any claim, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Teton County, Wyoming, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will update the “Effective” date at the top of the page. Your continued use of the Services after an update constitutes acceptance of the updated Terms.
